Welcome to Balloony Toons. These Terms and Conditions explain the rules that apply when you visit our website, place an order, or use our services. By using this website or submitting an order, you agree to these Terms and Conditions.

In these terms, “Balloony Toons,” “we,” “us,” and “our” refer to Balloony Toons LLC. “You” and “customer” refer to the person visiting the website or placing an order.

1. Our Products and Services

Balloony Toons creates customized balloon bouquets and coordinates their delivery within our available service area. Each bouquet is prepared by hand according to the options selected when the order is placed.

Product descriptions, photographs, colors, dimensions, and other information are provided to help you make your selection. Because every bouquet is handcrafted, the finished arrangement may vary slightly from photographs shown on our website.

2. Placing an Order

Orders are subject to availability, acceptance, and our ability to complete delivery at the requested location and time. Submitting an order does not guarantee acceptance if a product, delivery time, or delivery address is unavailable.

Orders must be placed at least 48 hours before the requested delivery time. Available ordering dates and delivery windows are displayed during the ordering process.

You are responsible for reviewing your order before submitting it, including:

• The selected bouquet and customization choices
• The recipient’s name
• The complete and accurate delivery address
• A working contact phone number
• The requested delivery date and time window
• The personal message, when one is included

We reserve the right to decline or cancel an order when necessary, including when information is incomplete, a pricing or website error has occurred, materials are unavailable, the delivery location is outside our service area, or we reasonably suspect fraudulent or unauthorized activity.

If we cancel an accepted and paid order, we will provide an appropriate refund to the original payment method.

3. Pricing and Payment

Prices are displayed in U.S. dollars and may be changed without notice. The price that applies to your order is the price shown during checkout when the order is submitted,
unless an obvious pricing or technical error has occurred.

Payment is required when the order is placed. You represent that you are authorized to use the payment method submitted with your order.

Delivery within the approved service area is included in the displayed order price unless otherwise clearly stated during checkout.

4. Handcrafted Products and Natural Variations

Balloon bouquets are handcrafted products. Minor differences in balloon placement, ribbon style, arrangement shape, size, and color appearance are normal and do not
constitute a defect.

Colors may also appear differently depending on lighting, photography, screen settings, balloon material, and manufacturer variations.

5. Product Availability and Substitutions

Balloon styles, printed foil designs, colors, ribbons, weights, and accessories are subject to availability. Occasionally, an item may become unavailable after an order
has been placed.

When a reasonable substitution is necessary, we may replace an unavailable item with one of comparable or greater value while preserving the selected occasion, general
color palette, and overall style of the bouquet as closely as possible.

If a significant substitution would materially change the character of the order, we will make a reasonable effort to contact you before proceeding.

6. Changes and Cancellations

Please contact us as soon as possible if you need to change or cancel an order. Requested changes are not guaranteed after production has begun or a delivery route has been finalized.

Orders canceled more than 24 hours before the scheduled delivery time are eligible for a full refund to the original payment method.

Orders canceled within 24 hours of the scheduled delivery are generally nonrefundable because materials, preparation, and delivery scheduling may already have been committed.

7. Delivery

Delivery dates and times are subject to availability. Unless we expressly confirm an exact delivery time, any selected time represents a delivery window rather than a guarantee that delivery will occur at a precise minute.

Delivery times may be affected by traffic, weather, road conditions, building access, recipient availability, and other circumstances beyond our reasonable control.

We will make reasonable efforts to complete delivery within the scheduled window and will communicate with the customer when a significant delay or problem arises.

8. Accurate Delivery Information

The customer is responsible for providing a complete and accurate delivery address, recipient name, access instructions, and working telephone number.

This includes relevant apartment, suite, unit, building, gate, business, floor, or department information.

Balloony Toons is not responsible for a failed or delayed delivery caused by incorrect, incomplete, or inaccessible delivery information supplied by the customer.

Additional charges may apply if another delivery attempt is requested or required because the original information was inaccurate or incomplete.

9. Recipient Availability and Delivery Completion

The customer is responsible for helping ensure that the recipient or another authorized person is available to receive the bouquet at the delivery location.

If the recipient is unavailable, we may attempt to contact the customer or recipient using the information provided with the order.

When appropriate and reasonably safe, an order may be left with a receptionist, front desk, concierge, coworker, household member, or another responsible person at
the delivery location. We will not leave balloons unattended when we believe doing so could create a safety concern or expose the order to damage, theft, animals, extreme
temperatures, or severe weather.

A delivery may be considered complete when the bouquet has been transferred to the recipient or another responsible person at the correct delivery address.

10. Weather and Circumstances Beyond Our Control

Safety comes first. Delivery may be delayed, rescheduled, or canceled because of severe weather, unsafe road conditions, natural disasters, vehicle problems, government
restrictions, building closures, or other circumstances beyond our reasonable control.

When we cannot safely complete a delivery, we will contact you to discuss an appropriate solution, which may include rescheduling, substitution, store credit, or a refund when appropriate.

11. Balloon Care and Longevity

Balloon appearance and float time can be affected by temperature, direct sunlight, humidity, altitude, handling, sharp surfaces, ceiling textures, pets, and other
environmental conditions.

Once a bouquet has been delivered in satisfactory condition, Balloony Toons is not responsible for damage or reduced float time caused by improper handling, outdoor
exposure, extreme temperatures, pets, children, sharp objects, or conditions outside our control.

Care instructions provided with the bouquet should be followed for the best possible results.

12. Balloon Safety

Balloons, ribbons, strings, weights, plastic packaging, and small accessories can present choking, suffocation, or entanglement hazards. Adult supervision is required
around children and pets.

Broken and uninflated balloons should be discarded immediately. Latex balloons may cause an allergic reaction in individuals with a latex sensitivity or allergy.

Helium should never be inhaled. Inhaling helium can cause serious injury or death. Balloons should also be kept away from power lines, electrical equipment, open flames,
and sources of extreme heat.

The customer is responsible for communicating relevant safety information to the recipient and supervising the use of delivered products.

13. Quality Concerns

We take pride in our work and want both the customer and recipient to be happy with every delivery.

Quality concerns should be reported within 24 hours of delivery. We may request photographs or other information to help us understand and resolve the issue.

Depending on the circumstances, an appropriate resolution may include a replacement, partial refund, full refund, or store credit. Remedies are determined based on the
nature of the issue and applicable law.

14. Promotional Offers and Discount Codes

Promotional offers and discount codes may be subject to additional conditions, expiration dates, product restrictions, delivery limitations, or minimum purchase
requirements.

Unless otherwise stated, promotions cannot be combined, exchanged for cash, applied to previous purchases, or transferred. We may discontinue or correct a promotion
when an error, misuse, or unauthorized distribution occurs.

15. Customer Photos, Messages, and Other Content

You are responsible for ensuring that any message, photograph, wording, or other material submitted with an order is lawful and that you have permission to use it.

You may not submit content that is threatening, discriminatory, obscene, defamatory, unlawful, deceptive, or that violates another person’s privacy or intellectual
property rights.

We reserve the right to decline content or an order that we reasonably believe is inappropriate, unlawful, unsafe, or inconsistent with our business values.

16. Optional Marketing Permission

We will use photographs or videos connected to an identifiable customer, recipient, or private delivery only when appropriate permission has been provided or when another lawful basis permits the use.

Choosing not to provide marketing permission will not affect your ability to purchase from Balloony Toons.

17. Website Use

You may use this website only for lawful personal or business purposes. You may not:

• Attempt to interfere with the operation or security of the website
• Use automated tools to improperly access or copy website content
• Submit false, fraudulent, or misleading information
• Use the website to violate another person’s rights
• Attempt to place an unauthorized or fraudulent order
• Introduce malicious code, viruses, or harmful technology

We may restrict access to the website or cancel an order when we reasonably believe misuse or unlawful activity has occurred.

18. Intellectual Property

Unless otherwise stated, the Balloony Toons name, logo, website copy, product descriptions, photographs, graphics, character artwork, designs, downloadable
materials, and other original content are owned by or licensed to Balloony Toons LLC.

This content may not be reproduced, republished, sold, distributed, modified, or used commercially without prior written permission, except as permitted by law.

19. Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment processors, website platforms, mapping services, analytics providers, and social media
platforms.

We are not responsible for the content, availability, security practices, or privacy policies of independently operated third-party websites and services.

20. Website Availability and Accuracy

We work to keep our website accurate and available, but we do not guarantee that it will always operate without interruptions, delays, technical problems, or errors.

We may correct errors, update information, change product availability, or modify website content at any time. If an error materially affects a submitted order, we
will contact the customer and provide an appropriate opportunity to approve the correction or cancel the affected order.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Balloony Toons LLC will not be liable for indirect, incidental, special, or consequential losses arising from the
use of this website, delayed delivery, or the use or handling of our products.

To the fullest extent permitted by applicable law, our total liability relating to an individual order will not exceed the amount paid for that order.

Nothing in these Terms and Conditions excludes or limits any right or remedy that cannot legally be excluded or limited.

22. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of this website, your violation of these
Terms and Conditions, or content you submit without the necessary rights or permission.

23. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Nothing in these terms limits any consumer protection right available to you under applicable federal, state, or local law.

24. Changes to These Terms

We may update these Terms and Conditions as our services, website, or legal obligations change. The revised version will be posted on this page with an updated effective date.

Changes apply from the date they are posted and do not retroactively change the terms applicable to an order already accepted unless required by law or agreed to by the
customer.

25. Severability

If any portion of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
